EULA - End User License Agreement
This Agreement is only a license to use this Software. It is not a transfer of title to the Software. If you agree to these terms of use, click the I accept the agreement button below to continue the installation. If you do not agree click I do not accept the agreement and delete all files installed on your computer and destroy all physical copies of the Software. The license granted under this Agreement grants you a limited, non-exclusive license to do only the following: 1. Download, and/or install the Software on up to 3 (three) computers for your personal or commercial use. 2. Make one copy of the Software in machine-readable form solely for backup or archival purposes for the computer on which the Software is installed. This Software is copyrighted and protected by US law and International Treaties. As an express condition of the license granted by this Agreement, you agree to reproduce this Agreement with any such backup copy as well as any other copyright notice and proprietary legends accompanying the original Software supplied by Cabinet Planner. The license granted under this Agreement prohibits you from doing any of the following: 1. Decompiling, reverse engineering, disassembling, or otherwise reducing the Software to a human readable form. 2. Decompiling, reverse engineering, disassembling, or otherwise manipulating the software or the program to gain access to the source code of the Software. 3. Modifying, copying, reproducing, adapting, translating, renting, leasing, loaning, selling, distributing, or otherwise assigning or transferring the Software, or creating derivative works based upon the Software or any part thereof, except as expressly provided in this Agreement. 4. Removing any copyright notice, trademark, or proprietary legend included in the Software. LIMITED WARRANTY -- CABINET PLANNER WARRANTS THAT FOR A PERIOD OF NINETY (90) DAYS AFTER PURCHASE THE SOFTWARE WILL PERFORM IN ALL MATERIAL RESPECTS THE ESSENTIAL FUNCTIONS FOR WHICH IT IS DESIGNED; PROVIDED, HOWEVER, THAT CABINET PLANNER DOES NOT WARRANT THAT THE SOFTWARE WILL BE FREE FROM ERRORS, CAN BE USED WITHOUT INTERRUPTION OR THAT ALL PROGRAM ERRORS WILL OR CAN BE CORRECTED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CABINET PLANNER DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE SOFTWARE AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE TO STATE. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CABINET PLANNER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF CABINET PLANNER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, CABINET PLANNERS ENTIRE LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE.
